This Acceptable Use and Privacy Policy regulates the terms and conditions for the download and use of Extinguisher 360 by users on compatible devices. Extinguisher 360 Inc. and/or ExtinPros S.R.L. reserve the right to change this policy whenever deemed appropriate, at any time, with or without prior notice.
Ownership
Extinguisher 360 Inc. and/or ExtinPros S.R.L. are the owners and legitimate licensees of the intellectual and industrial property rights over Extinguisher 360, including trademarks, content arrangement, computer programs, sui generis rights over underlying databases (including source and object codes), graphic design, and user interface (look & feel), as well as the various elements comprising Extinguisher 360 (texts, graphics, photographs, videos, recordings, etc.). Access to Extinguisher 360 does not grant users any rights over the intellectual and/or industrial property rights of Extinguisher 360. Extinguisher 360 Inc. and/or ExtinPros S.R.L. reserve the possibility of taking legal action against users for infringement of Extinguisher 360's intellectual and/or industrial property rights.
License & Restrictions on Use
Users are granted a limited, non-exclusive, revocable, and non-transferable license to use Extinguisher 360 strictly for its intended purpose. Any modification, reverse engineering, decompilation, distribution, sublicensing, or other unauthorized use of the software, its components, or intellectual property is strictly prohibited. Any violation of these terms will result in immediate termination of access and may lead to legal action.
Purpose
Extinguisher 360 is an application intended exclusively to facilitate the registration of inspections and maintenance of fire extinguishers. The main purpose is to ensure compliance with the National Fire Protection Association (NFPA) standards, promote user safety, and mitigate the risk of fires.
Authorized Users
Access to Extinguisher 360 is reserved only for designated and authorized users.
QR Codes
Users must exclusively use the QR code labels provided by Extinguisher 360 Inc. Tampering with, replicating, or using unauthorized QR codes is strictly prohibited.
Liability of Use
Authorized users are responsible for ensuring the accuracy and truthfulness of the information entered into the application during inspections and fire extinguisher registration. Any inaccurate or incomplete information may affect the effectiveness of inspections and overall safety. THE USER ACCEPTS THAT THE USE OF EXTINGUISHER 360 MUST BE DONE AT THEIR OWN RISK. EXTINGUISHER 360 INC. AND/OR EXTINPROS S.R.L. PROVIDE THE SOFTWARE "AS-IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Extinguisher 360 Inc. and/or ExtinPros S.R.L. shall not be liable for any direct, indirect, incidental, consequential, or special damages (including but not limited to loss of data, profits, business opportunities, or person injury arising from the use or inability to use Extinguisher 360 and its content, even if advised of the possibility of such damages. Users agree to indemnify, defend, and hold harmless Extinguisher 360 Inc. and/or ExtinPros S.R.L. from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from their misuse of Extinguisher 360, violation of this policy, or any breach of applicable laws.
Proper Use
Extinguisher 360 should only be used for purposes related to the management of fire extinguishers and compliance with inspections. Any misuse or malicious use of the application, or any action that could damage the image, interests, and rights of Extinguisher 360 Inc. and/or ExtinPros S.R.L., is strictly prohibited and may result in legal action and access cancellation.
Data Collection and Privacy
Extinguisher 360 Inc. collects and processes data from users and their companies, including personal information, inspection records, and usage logs. This data may be used by Extinguisher 360 Inc., its partners, subcontractors, and related companies to offer services that Extinguisher 360 Inc. considers beneficial to the client. Users consent to this data collection and processing as part of the service.
Users have the right to access, rectify, delete, and object to the processing of their personal data under applicable law. By using Extinguisher 360, users consent to the collection and processing of their information necessary for the operation of the application.
Extinguisher 360 Inc. takes reasonable technical and organizational measures to protect user data from unauthorized access, loss, misuse, or alteration. However, users acknowledge that no security measures are infallible, and Extinguisher 360 Inc. is not responsible for unauthorized third-party access beyond its control.
Location Access
To accurately register the position or locality of your fire extinguishers, Extinguisher 360 requests and uses your device’s location data at the time of inspection or initial registration. By capturing exact geographic coordinates (latitude and longitude), we ensure that each extinguisher in your inventory is linked to its real-world location, facilitating audit-ready reporting, streamlining maintenance workflows, and supporting compliance with applicable safety standards. All location data is transmitted over secure, encrypted channels, stored alongside your inspection records in our protected databases, and retained only for as long as necessary to fulfill these operational and regulatory purposes. You may manage or revoke location permissions at any time through your device settings; however, disabling location access may limit certain essential features of the application.
Children’s Privacy
Extinguisher 360's services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
Automatic Updates to Fire Extinguisher Quantities
Extinguisher 360 Inc. reserves the right to update the number of fire extinguishers associated with a client’s account for billing purposes based on modifications made by the customer and/or user. This ensures that invoicing accurately reflects the number of fire extinguishers being managed through the application.
Maintenance and Updates
Extinguisher 360 is committed to providing reliable service and regular updates to improve functionality. Users should ensure they have the latest version of the application installed. Extinguisher 360 Inc. and/or ExtinPros S.R.L. reserve the right to update, modify, or delete information contained in Extinguisher 360 and may limit or disallow access to such information without prior notice.
Service availability may be affected by maintenance, upgrades, security issues, or factors beyond Extinguisher 360 Inc.’s control. Users acknowledge that Extinguisher 360 Inc. is not responsible for any service interruptions or loss of data resulting from such events.
Cooperation and Support
Authorized users must cooperate with the Extinguisher 360 team to resolve any technical issues. Technical assistance and support will be provided to ensure a satisfactory user experience.
Risk and Fire Safety Disclaimer
Users acknowledge the risks of fire inside and outside facilities and are responsible for planning appropriate safety measures. In the event of a fire, the user must notify the fire department immediately. Users agree that Extinguisher 360 is a tool to assist in fire extinguisher management but does not replace professional fire safety advice, inspections, or emergency response protocols
Governing Law & Dispute Resolution
This policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising under or in connection with this policy shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association (AAA), with each party bearing its own costs.
Acceptance of Terms
By using Extinguisher 360, users agree to comply with this Acceptable Use and Privacy Policy. Any violation of this policy may result in suspension of access to Extinguisher 360. Safety is our top priority, and we appreciate our users' commitment to ensuring a safer environment.

El acceso y uso de Extinguisher 360 no concede a los usuarios derechos sobre la propiedad intelectual e industrial del software. Cualquier violación dará lugar a la terminación del acceso y podrá derivar en acciones legales.
Licencia y Restricciones de Uso
Se otorga a los usuarios una licencia limitada, no exclusiva, revocable e intransferible para utilizar Extinguisher 360 estrictamente para su propósito previsto. Se prohíbe estrictamente:
• Modificar, descompilar, realizar ingeniería inversa, distribuir, sublicenciar o hacer cualquier otro uso no autorizado del software.
• Utilizar el software para fines distintos a los permitidos, o que puedan dañar la imagen, intereses o derechos de Extinguisher 360 Inc. y/o ExtinPros S.R.L.
Cualquier infracción resultará en la cancelación inmediata del acceso y posibles acciones legales.
Finalidad
Extinguisher 360 es una aplicación diseñada exclusivamente para facilitar el registro de inspecciones y mantenimiento de extintores de incendios. Su propósito principal es garantizar el cumplimiento de las normas de la National Fire Protection Association (NFPA), promover la seguridad de los usuarios y reducir el riesgo de incendios.
Usuarios Autorizados
El acceso a Extinguisher 360 está reservado exclusivamente a usuarios designados y autorizados.
Uso de Códigos QR
Los usuarios deben utilizar únicamente las etiquetas de códigos QR proporcionadas por Extinguisher 360 Inc. Está estrictamente prohibido manipular, replicar o utilizar códigos QR no autorizados.
Responsabilidad del Uso
Los usuarios autorizados son responsables de garantizar la veracidad y precisión de la información ingresada en la aplicación durante las inspecciones y el registro de extintores. EL USUARIO ACEPTA QUE EL USO DE EXTINGUISHER 360 SE REALIZA BAJO SU PROPIO RIESGO. EXTINGUISHER 360 INC. Y/O EXTINPROS S.R.L. PROPORCIONAN EL SOFTWARE “TAL CUAL”, SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUYENDO GARANTÍAS DE COMERCIABILIDAD O ADECUACIÓN PARA UN PROPÓSITO PARTICULAR. Extinguisher 360 Inc. y/o ExtinPros S.R.L. no serán responsables por daños directos, indirectos o consecuenciales derivados del uso del software. Los usuarios aceptan indemnizar y eximir de responsabilidad a Extinguisher 360 Inc. y/o ExtinPros S.R.L. ante cualquier reclamación, daño o pérdida derivada del uso indebido del software o el incumplimiento de esta política.
Uso Adecuado
Extinguisher 360 debe utilizarse exclusivamente para la gestión de extintores de incendios y el cumplimiento de inspecciones conforme a las normativas aplicables. Está estrictamente prohibido cualquier uso indebido, incluyendo, pero no limitado a:
· Utilizar la aplicación con fines distintos a los autorizados.
· Manipular, modificar o alterar la información registrada de manera fraudulenta.
· Compartir credenciales de acceso con terceros no autorizados.
· Realizar acciones que puedan dañar la imagen, intereses o derechos de Extinguisher 360 Inc. y/o ExtinPros S.R.L.
Cualquier violación de estas normas podrá derivar en la cancelación inmediata del acceso y posibles acciones legales contra el usuario responsable.
Recolección de Datos y Privacidad
Extinguisher 360 Inc. podrá recopilar y procesar datos de los usuarios y de sus empresas, incluyendo información personal, registros de inspección y datos de uso. Esta información podrá ser utilizada por Extinguisher 360 Inc., sus socios, subcontratistas y empresas relacionadas para ofrecer servicios que considere útiles para el cliente.
Los usuarios tienen derecho a acceder, rectificar, eliminar y oponerse al tratamiento de sus datos personales conforme a la legislación aplicable.
Extinguisher 360 Inc. implementa medidas de seguridad adecuadas para proteger la información de accesos no autorizados. Sin embargo, los usuarios reconocen que ninguna medida es completamente infalible y Extinguisher 360 Inc. no se hace responsable de accesos no autorizados por terceros fuera de su control.
Acceso a la Ubicación
Para registrar de forma precisa la posición o localidad de sus extintores, Extinguisher 360 solicita y utiliza los datos de ubicación de su dispositivo al momento de la inspección o del registro inicial. Al capturar coordenadas geográficas exactas (latitud y longitud), garantizamos que cada extintor en su inventario quede asociado a su posición real, lo que facilita la generación de reportes auditables, optimiza los flujos de trabajo de mantenimiento y respalda el cumplimiento de las normas de seguridad aplicables. Toda la información de ubicación se transmite mediante canales seguros y encriptados, se almacena junto con sus datos de inspección en nuestras bases de datos protegidas, y se conserva únicamente durante el tiempo necesario para cumplir con estos fines operativos y regulatorios. Usted puede administrar o revocar en cualquier momento los permisos de ubicación desde la configuración de su dispositivo; no obstante, deshabilitar este acceso puede limitar el funcionamiento de algunas características esenciales de la aplicación.
Privacidad de Menores de Edad
Los servicios de Extinguisher 360 no están dirigidos a menores de 13 años. Si un padre o tutor detecta que un menor ha proporcionado datos personales, debe contactarnos para su eliminación inmediata.
Actualización Automática del Número de Extintores
Extinguisher 360 Inc. se reserva el derecho de actualizar el número de extintores registrados en una cuenta con fines de facturación, basándose en modificaciones realizadas por el cliente y/o usuario.
Mantenimiento y Actualizaciones
Extinguisher 360 se compromete a ofrecer un servicio confiable con actualizaciones periódicas para mejorar su funcionalidad.
Extinguisher 360 Inc. y/o ExtinPros S.R.L. se reservan el derecho de actualizar, modificar o eliminar información contenida en la aplicación sin previo aviso.
Los usuarios reconocen que Extinguisher 360 Inc. no es responsable por interrupciones del servicio derivadas de mantenimiento, actualizaciones o factores fuera de su control.
Cooperación y Soporte
Los usuarios autorizados deberán cooperar con el equipo de Extinguisher 360 para resolver cualquier problema técnico. Se ofrecerá soporte técnico para garantizar una experiencia satisfactoria.
Descargo de Responsabilidad sobre Seguridad Contra Incendios
Los usuarios reconocen los riesgos de incendio y son responsables de implementar medidas de seguridad adecuadas. En caso de incendio, el usuario deberá notificar de inmediato al cuerpo de bomberos correspondiente. Extinguisher 360 es una herramienta de gestión, pero no sustituye el asesoramiento profesional en seguridad contra incendios ni las inspecciones obligatorias.
Legislación Aplicable y Resolución de Conflictos
Esta política se rige por las leyes del Estado de Delaware, Estados Unidos de América, sin perjuicio de los principios de conflicto de leyes. Cualquier disputa deberá resolverse mediante negociaciones de buena fe. Si la disputa no se resuelve, se someterá a arbitraje vinculante en Wilmington, Delaware, bajo las reglas de la Asociación Americana de Arbitraje (AAA) y cada una de las partes cubrirá sus costos.
Aceptación de Términos
Al utilizar Extinguisher 360, los usuarios aceptan cumplir con esta Política de Uso Aceptable y Privacidad. Cualquier violación de esta política podrá resultar en la suspensión del acceso a Extinguisher 360. La seguridad es nuestra prioridad, y agradecemos el compromiso de los usuarios en garantizar un entorno más seguro.
